Say you’ve bought goods on the internet, but when they arrive they are not as ordered, or the parcel is empty. What do you do?
In Turkey, the Consumer Protection Act (CPA) 4077 E categorizes such transactions as “distance purchase”. In this case, the vendor / provider must deliver the order within 30 days of the date of purchase. The vendor / provider may only extend this for a maximum of ten days via written notification to the consumer.
Consumers in Turkey have a very important right when making a distance purchase called “Right of withdrawal”. The buyer may terminate the purchase contract and return the goods without providing any reason within 7 days of delivery. The cost must be borne by the vendor should the consumer exercise his or her right of withdrawal. The vendor / provider is obliged to accept the returned goods within 20 days of the consumer‘s notification of withdrawal. The vendor / provider is further obliged to return the money within 10 days of the consumer‘s notification of withdrawal.
Thus, if a consumer does not wish to keep goods purchased on the internet, he or she must notify the vendor / provider by registered post, and then either return the goods or leave the vendor / provider to collect them by courier or other means. Even if the delivery of the goods has been made by a person other than the vendor / provider, a consumer still may utilize the right of withdrawal. In this case the vendor / provider pick up the goods from the third party to the contract.
